Defendant murdered Kellie Colleen O'Sullivan on September 14, 1993, and was arrested, tried, convicted of a number of crimes, and sentenced to death. The jury convicted defendant of the murder of O'Sullivan (Pen.Code,1 § 187), and of kidnapping her for robbery (§ 209, subd. (b)).
