WOLLHEIM, J.

Plaintiff appeals a judgment dismissing his complaint, with prejudice, for failure to commence his action within the statute of limitations. ORCP 21 A(9). The trial court concluded that plaintiff did not file his complaint within the one-year statute of limitations prescribed in ORS 65.167(4) for "[a]ny proceeding challenging an expulsion" from a public benefit or mutual benefit corporation, such as defendant Multnomah Athletic Club (MAC).
