Although originally indicted for first degree murder, a jury ultimately convicted Defendant, Justin Charles Singleton, of second degree murder, in violation of La.R.S. 14:30.1, on December 17, 2004.

On January 28, 2005, Defendant moved for a new trial in open court based on unfair prejudice caused by the erroneous admission of evidence obtained through an illegal search. Defendant later filed a supplemental motion for new trial with allegations...
