I. INTRODUCTION

This appeal arises from the superior court's denial of a motion for a new trial. The verdict at issue arose from a negligence action that Donald Hogg brought against Raven Contractors and Kenai Peninsula Borough after Hogg fell into a trash container at the Kenai Transfer Facility.
