This matter comes before the Court pursuant to Plaintiffs' Motion for Summary Judgment (Doc. # 42), filed on February 27, 2006, and Defendant's Motion for Summary Judgment and to Dismiss for Lack of Subject Matter Jurisdiction (Doc. # 49), filed on March 1, 2006.
