HANSON, Justice.

Appellant Daniel E. Angus was found guilty of two counts of first-degree murder and the lesser-included offense of second-degree murder as an accomplice to the drive-by shooting of Anthony Basta. Basta was shot in the back on April 26, 2000, as he rode his bicycle along Mississippi River Boulevard in Saint Paul. Angus did not file a direct appeal, but petitioned for postconviction relief.
