OPINION

MATHIAS, Judge.

Michael LaRose's ("LaRose") Motion to Dismiss was denied in Hamilton Superior Court. LaRose brings this interlocutory appeal, raising the following restated issue for review: Whether Indiana Code section 35-42-4-61 is unconstitutional. Concluding that Indiana Code section 35-42-4-6 is constitutional, we affirm.
