¶ 1. On July 11, 2003, in the Marion County Circuit Court, Dwight Smith entered a plea of guilty to burglary of a building as an habitual offender. Smith was sentenced to serve seven years in the custody of the Mississippi Department of Corrections. On August 10, 2004, Smith filed a motion for post-conviction relief.
