[¶ 1.] A grand jury indicted David McCrary (McCrary) on one count of Rape in the First Degree and three counts of Sexual Contact with a Child under Sixteen. Pursuant to a plea agreement, McCrary pleaded guilty to two counts of Child Abuse. The trial court sentenced McCrary to serve two consecutive ten-year sentences in the South Dakota State Penitentiary, with the second ten-year sentence suspended on several conditions.
