The defendant, Nursing Homes Management, Inc. d/b/a Chateau D'Arbonne (Chateau), contends that the claims of the plaintiff, Sara Miller, through her duly qualified curatrix, Mammie Miller, were based on medical malpractice.1 Because the plaintiff did not first convene a medical review panel, Chateau argues that the present suit for damages was premature.
