Allen Tegtmeier sued the Midwest Operating Engineers Pension Trust Fund (the "Pension Fund") for improper administration and breach of fiduciary duties under the Employee Retirement Income Security Act ("ERISA"), 29 U.S.C. §§ 1001, et seq., alleging the defendant improperly calculated his disability award.
