LOKEN, Chief Judge.

Stephen Rydale Bolden pleaded guilty to a superseding information charging him with misprision of felony in violation of 18 U.S.C. § 4. The district court1 departed upward and sentenced Bolden to three years in prison, the statutory maximum sentence for a misprision offense, because of Bolden's conduct relating to a dismissed drug conspiracy charge, and because he was guilty of the felony underlying his misprision...
