Justice TURNER delivered the opinion of the court:

In November 2001, the State charged defendant, Alonzo Bass, with one count of driving while under the influence of alcohol (DUI) and one count of driving with a blood-alcohol concentration of 0.08 or greater. In June 2002, a jury found defendant guilty of driving with a blood-alcohol concentration of 0.08 or greater. In August 2002, the trial court denied defendant's posttrial motion and sentenced him to 24 months...
