THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JACINTO ZAMORANO, Appellant.

Appellate Division of the Supreme Court of the State of New York, Second Department.

Decided January 13, 2003.


Ordered that the judgment is reversed, as a matter of discretion in the interest of justice, and a new trial is ordered before a different Justice.

While none of the errors complained of were objected to at trial, we nevertheless feel compelled, under the circumstances of this case, to reach them in the exercise of our interest of justice jurisdiction and to reverse (see People v Mendez, 225 A.D.2d 1051).
