Ordered that the appeals by the defendants Starrett City, Inc., and Starrett City Associates are dismissed, as those defendants are not aggrieved by the portion of the order appealed from (see CPLR 5511); and it is further,

Ordered that the order is reversed insofar as reviewed, on the law, that branch of the cross motion which was for summary judgment dismissing the complaint and all cross claims insofar as asserted against the defendants Starrett Brothers...
