This matter is before the court on a sua sponte inquiry into the subject matter jurisdiction of the court (doc. 14), and on a motion by defendants, Tracer Construction Company, Bill Mueller, and Paul Dubroc, for judgment on the pleadings and for summary judgment (doc. 6).
