EMMANUEL v. STATE

No. 4D01-348.

844 So.2d 807 (2003)

Thomas EMMANUEL, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

May 14, 2003.

Attorney(s) appearing for the Case

Carey Haughwout, Public Defender, and Peggy Natale, Assistant Public Defender, West Palm Beach, for appellant.

Charles J. Crist, Jr., Attorney General, Tallahassee, and Frank J. Ingrassia, Assistant Attorney General, Fort Lauderdale, for appellee.

PER CURIAM.

We affirm appellant's, Thomas Emmanuel, conviction on the charge of impregnating a child under the age of sixteen; however, we remand for resentencing. Appellee concedes, and we agree, appellant must be resentenced under the 1994 sentencing guidelines rather than the 1995 sentencing guidelines with a corrected scoresheet as argued by appellee.
