On August 27, 1998, the appellant, Melvin Davis, was convicted of capital murder for murdering two or more people pursuant to one scheme or course of conduct, see § 13A-5-40(a)(10), Ala.Code 1975, and two counts of burglary-murder, see § 13A-5-40(a)(4), Ala.Code 1975. He was also convicted of attempted murder and conspiracy to commit murder. By a vote of 10-2, the jury recommended that he be sentenced to death on the capital...
