THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. VALDAMER WILSON, Also Known as VALDEMAR WILSON, Appellant.

Ordered that the judgment is modified, on the law, by vacating the sentence imposed thereon; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Queens County, for resentencing by a different justice.

Viewing the evidence in the light most favorable to the prosecution (see People v Contes, 60 N.Y.2d 620 [1983]), we find that it was legally sufficient to establish the defendant's guilt...
