In this case, we consider whether a prisoner's transfer and reclassification in retaliation for exercising his First Amendment rights could, if proven, constitute "adverse determinations" under the Privacy Act. Answering yes and finding that the prisoner adequately alleges the other elements of a Privacy Act damages claim, we reverse the district court's dismissal and remand for further...
