On February 5, 1997, plaintiff Susan Kane was crossing Third Avenue at 69th Street when she was struck by a United States Postal Service truck. She brought this action to recover for her injuries. The case was tried to the Court without a jury from February 4 through February 11, 2002. For the reasons set forth below, judgment will be entered in favor of Kane against the United States.
