The State charged Dennis Townsell with first degree murder. Ill.Rev.Stat.1991, ch. 38, par. 9-1(a)(1). In the charging instrument, the State specifically alleged that on February 18, 1991, without lawful justification and with intent to kill, Townsell caused Terry Biscontine's death by shooting, stabbing, and choking him.
