BRUNO'S INC./FOOD WORLD v. BRUNER

No. 1D00-3181.

805 So.2d 1090 (2002)

BRUNO'S, INC./FOOD WORLD and ITT-Specialty Risk Services, Inc., Appellants, v. Ben BRUNER, Appellee.

District Court of Appeal of Florida, First District.

February 1, 2002.

Attorney(s) appearing for the Case

Curt L. Harbsmeier and Claude M. Harden, III of Harbsmeier, Dezayas, Appel & Hernandez, LLP, Lakeland; Susan W. Fox and Brendan M. Lee of MacFarlane Ferguson & McMullen, Tampa for Appellants/Cross-Appellees.

Loren E. Levy of The Levy Law Firm, Tallahassee; Sean Culliton of Anderson, Culliton, & Sullivan, P.A., Tallahassee for Appellee/Cross-Appellant.

PER CURIAM.

We find no error in the award of temporary partial disability benefits and therefore reject the argument made in the main appeal. However, we conclude that the claimant has shown reversible error as to the issue presented in the cross appeal. The claimant is entitled to an award of penalties, because the evidence supporting the claim of temporary partial disability benefits was available to the employer and carrier at the time they declined payment.
