¶ 1. The Mississippi Department of Human Services brings this appeal after the chancellor dismissed its petition for contempt with prejudice based on a failure to prosecute. Finding that the chancellor erred in dismissing the petition with prejudice, we reverse his judgment to the extent that he dismissed Victory's amended petition and remand the case for further proceedings.
