Defendant, Kevin Braman, was charged by indictment with the Class 4 felony of aggravated driving under the influence of alcohol (DUI) (625 ILCS 5/11-501(a)(1)) (West 1998)(Vehicle Code). In the indictment, it was alleged that the defendant had two prior DUI violations.
