Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the motion which was to dismiss the first cause of action for tuition reimbursement in its entirety and substituting therefore a provision granting that branch of the motion to the extent of dismissing that cause of action insofar as it seeks reimbursement for tuition payments made before June 29, 1996; as so modified, the order is affirmed, with costs, and the matter...
