FACTS

The defendant was indicted by a grand jury with the offense of forcible rape, a violation of La.R.S. 14:42.1. The indictment charged that, on August 24, 1996, the defendant forced the victim to have sexual intercourse. The defendant admitted to having sexual intercourse with the victim, but maintained it was consensual in nature.
