On November 17, 2000, John Underwood was convicted of first-degree robbery and first-degree theft of property, violations of §§ 13A-8-41(a)(1) and 13A-8-7, Ala.Code 1975, respectively. The trial court sentenced Underwood, as a habitual offender, to life in prison without the possibility of parole on the robbery charge. See § 13A-5-9(c)(3), Ala.Code 1975.
