This case arises from a judgment of the trial court finding a breach of the implied warranty of fitness. Plaintiff, James Diamond ("Mr. Diamond"), instituted proceedings in the trial court against Defendant, Interstate Dodge, Inc. ("Interstate Dodge"), alleging breach of the implied warranty of fitness.
