This legal malpractice case raises the issue of when the plaintiff should have discovered her attorney's negligent actions for purposes of the running of the one-year period of peremption under La. R.S. 9:5605. After a trial of the defendant's peremptory exception for prescription, the trial court determined that over one year had passed after plaintiff received information from her second attorney which was sufficient to alert her to the defendant's malpractice...
