On April 28, 1998, appellant Gerry Payne pled guilty to one count of attempted possession with intent to distribute cocaine.1 He was sentenced by the Superior Court on June 17, 1998, to a three to nine year term of incarceration (execution suspended as to all but thirty days), and to three years of supervised probation.
