James Michael Franklin was indicted for burglary, second degree, grand larceny, and criminal conspiracy. Franklin was convicted by a jury on the criminal conspiracy charge, and acquitted of the remaining charges. Franklin appeals the denial of his motion for a new trial, made on the ground of internal jury misconduct, and the refusal of the trial court to hold an evidentiary hearing on the issue of jury misconduct...
