The defendant, Charleton Russell, was charged by bill of information on August 7, 1996 with possession of twenty-eight or more grams, but less than two hundred grams, of cocaine, a violation of La. R.S. 40:967(F)(1). A jury found him guilty as charged. Defendant filed motion for new trial, which was denied. Defendant waived all delays and the trial court sentenced him to ten years at hard labor without benefit...
