The defendant, Herbert Allen, was charged with possession of cocaine with intent to distribute, violations of La. R.S. 40:967 and La. R.S. 40:979. Following a jury trial, the defendant was found guilty of the responsive charge of attempted possession and was sentenced to two years at hard labor to run concurrent with his sentence for a probation violation.
