EPPING v. COMMONWEALTH EDISON CO.

No. 1-99-3257.

734 N.E.2d 916 (2000)

315 Ill. App.3d 1069

248 Ill.Dec. 625

Nancy EPPING and Hugh Epping, Plaintiffs (Nancy Epping, Plaintiff-Appellee), v. COMMONWEALTH EDISON COMPANY, Defendant-Appellant.

Appellate Court of Illinois, First District, Third Division.

July 26, 2000.

Attorney(s) appearing for the Case

Clausen Miller P.C., Johnson & Bell, Ltd., Chicago (James T. Ferrini and Edward M. Kay, of counsel), for Defendant-Appellant.

Robert A. Clifford and Timothy S. Tomasik, Clifford Law Offices, Chicago (David A. Novoselsky and Leslie J. Rosen, David A. Novoselsky Associates, of counsel), for Plaintiff-Appellee.

Justice WOLFSON delivered the opinion of the court:

The only matter to consider in this case is whether a $9 million non-economic damages award by a jury falls outside the range of fair and reasonable compensation. Commonwealth Edison contends the award, standing alone or in comparison to awards in other cases, is excessive. It requests a new trial or a remittitur of $5 million. We affirm the jury's verdict.
