Charles B. Fuston appeals the summary denial of his motion to correct illegal sentence filed pursuant to Florida Rule of Criminal Procedure 3.800(a). Fuston contends that his sentence as a habitual violent felony offender to thirty years in prison for burglary of an occupied structure is illegal because the trial court entered a departure sentence without giving written reasons. He contends that his sentence exceeds the sentencing guidelines for the offense...
