This matter is before the court on appeal from the Lucas County Court of Common Pleas. The following facts are undisputed.

On December 23, 1998, appellant, David D. Wilton, entered a guilty plea to one count of R.C. 4511.19(A)(1), driving while under the influence of alcohol ("DUI"). As this was appellant's third offense in six years, he faced enhanced penalties pursuant to R.C. 4511.99(A)(4)(a). This was appellant's first felony...
