Appellant DalMac Construction Company ("DalMac") brought suit against appellees Texas A & M University and the Board of Regents of Texas A & M University ("A & M") for claims arising out of a construction project. A & M filed a plea to the jurisdiction asserting that its sovereign immunity from suit deprived the trial court of jurisdiction.
