THOMPSON, J.

Sheryl D. Smith ("Smith") appeals an adverse summary judgment in favor of Arrestor Holley1, a defendant in this automobile negligence case. Smith argues that the trial court erred in entering summary judgment because a deposition had been scheduled five days after the summary judgment hearing. We agree and reverse.
