PAGE, Justice.

On May 12, 1997, appellant Scott James Schmit was charged with two counts of criminal sexual conduct in the first degree for allegedly sexually assaulting his stepdaughter, K.A.T. In October 1997, Schmit pleaded guilty to one count of criminal sexual conduct in the first degree for the sexual assault of K.A.T. and in return, the other count was dismissed. Sentencing was scheduled for December 8, 1997, but was continued pending resolution...
