On 7 October 1996, defendant was indicted for two counts of first-degree murder. Defendant was tried capitally at the 6 October 1997 Criminal Session of Superior Court, Forsyth County. The jury found defendant guilty of both counts of first-degree murder on the basis of premeditation and deliberation and under the felony murder rule.
