The appellants, Victor Eugene Robbins, Sr. ("Gene"), Roy Gordon Robbins ("Gordon") and James Herriman, were charged in a three-count indictment with various offenses arising out of a large-scale marijuana operation. Count I charged the defendants with conspiracy to possess with intent to distribute marijuana in violation of 21 U.S.C. §§ 841(a)(1) and 846.
