On April 2, 1998, a federal grand jury in the Western District of Wisconsin returned an eight-count indictment against the defendant-appellant, Susan C. Spry ("Spry"). Count One of the indictment charged Spry with possession with intent to distribute methamphetamine, in violation of 21 U.S.C. § 841(a)(1).
