Lita Filippo brought this action against her employer, Northern Indiana Public Service Corporation ("NIPSCO"), and her union, United Steelworkers of America, AFL-CIO-CLC, Local Union 13796 ("Union"). Her complaint included a claim under § 301 of the Labor Management Relations Act ("LMRA"), 29 U.S.C. § 185, and a claim that NIPSCO's actions constituted intentional infliction of emotional distress under Indiana law.
