BOWMAN, Chief Judge.

Jerome Mallett, a prisoner in the custody of the State of Missouri pursuant to a conviction of capital murder, appeals from a final judgment of the District Court1 denying a writ of habeas corpus under 28 U.S.C. § 2254. See Mallett v. Delo,2 No. 90-437 C(2) (E.D.Mo. July 29, 1996). We affirm.
