OPINION

PRESKA, District Judge.

Plaintiff Richard Jewell ("Jewell") brings this diversity action for libel against defendant NYP Holdings, Inc. d/b/a The New York Post ("NYP"). The NYP moves for summary judgment pursuant to Federal Rule of Civil Procedure ("Fed.R.Civ.P.") 56 and for dismissal pursuant to Fed.R.Civ.P. 12(b)(6).
