Robert Smith (defendant) was charged by bill of information with two counts of filing false public records (counts 1 and 2) and one count of perjury (count 3), La. R.S. 14:133 and 14:123, respectively. Defendant filed a motion to quash counts one and two of the bill of information on the grounds they alleged conduct not proscribed by Louisiana Revised Statute 14:133 at the time of the alleged offenses....
