In 1991, Marcos Cruz-Mendoza (Cruz) was convicted of two drug offenses and sentenced to a 235-month term of imprisonment. That conviction and sentence were affirmed on direct appeal. United States v. Angulo-Ruiz, 978 F.2d 716 (table), 1992 WL 320963 (9th Cir.1992). Cruz then moved under 28 U.S.C. § 2255 to vacate, set aside or correct his sentence.
