This is an appeal from the appellant's conviction of rape in the second degree, a violation of § 13A-6-62, Code of Alabama 1975. The appellant was sentenced, pursuant to § 15-18-8, Code of Alabama 1975, the Split Sentence Act, to 10 years' imprisonment, with three years to be spent in actual confinement.1
