Shmael Turkhan is a citizen of Iraq who immigrated to the United States in 1979. In 1990, however, Turkhan pleaded guilty to a federal charge of conspiracy to distribute cocaine. The Immigration and Naturalization Service (INS) thereafter instituted deportation proceedings against him.
